Welcome to EvoWidget AI (the “App”). This App and its related services are provided to you by Brian S Rosales (“We”, “Us”, or “Our”) subject to these Terms of Service (the “Terms”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App. BY CONTINUING TO USE THE APP, YOU ARE INDICATING YOUR AGREEMENT TO THE TERMS AND ALL REVISIONS THEREOF.

1. Description of Service & The "Middleman" Role

EvoWidget AI serves strictly as a technical interface and intermediary tool. It allows you to submit text prompts or upload up to three (3) images ("Inputs"), transmits them securely via API to a third-party artificial intelligence engine hosted on Google Cloud Vertex AI to generate animated widgets or videos ("Outputs"), and provides an interface to download or save the results.

🔍 Crucial Disclosure: We do not generate the AI content, and we do not maintain a permanent database of your creations. Our service is powered entirely by Google’s foundational AI models—specifically Veo (for video generation) and Imagen 3 (for image generation). We act solely as a conduit facilitating the interaction between Google's AI models and your device.

2. Temporary Content Hosting & The 48-Hour Deletion Policy

To deliver your generated animated widgets and videos, our servers temporarily host the source inputs and generated files.

  • 48-Hour Buffer: All uploaded source images and generated video content are hosted on our temporary server for a maximum of 48 hours from the exact time of creation.
  • User Downloading Responsibility: You must download the generated video to your device or sync it to your private iCloud account within this 48-hour window.
  • Automatic Purge & No Liability: Upon the expiration of the 48-hour window, the source images and generated content are permanently and automatically deleted from our temporary servers. We hold zero responsibility or liability for the deletion of your content if you fail to download it within 48 hours. Deleted content cannot be recovered by us.

3. Account Tracking via Random UUID & Analytics

To protect your privacy while ensuring proper functionality, EvoWidget AI does not require you to create a traditional account using personal identifying information (such as your name, email, or phone number).

  • Anonymous Tracking: Instead, the App generates a localized, random Universally Unique Identifier (UUID) linked to your device. This anonymous UUID is used solely to keep track of your device's video generation requests, temporary file associations, and token/purchase history within our system.
  • Usage Analytics: We collect anonymous, aggregated usage data and performance telemetry (such as feature engagement patterns, technical logs, and crash reports) to maintain app stability, optimize performance, and improve future updates. This data contains no personally identifiable information.
  • Device Changes: Because your data is tied strictly to a random device UUID, if you delete the App, clear your device data, or lose your device, your transaction history, analytics profile, and temporary generation access may be permanently lost.

4. Pay-Per-Generation Model & Consumable In-App Purchases

The App does not offer or charge for ongoing, recurring subscription plans. Instead, EvoWidget AI operates on a pay-per-generation model utilizing consumable credit packs (specifically packages of 1, 3, or 5 generation tokens).

  • Token Consumption: One (1) credit token is deducted from your local balance for every video or image generation request successfully processed. Purchased tokens do not expire as long as the App remains installed on your device, but they carry no monetary or cash value outside of the App infrastructure.
  • Payment Processing: All transactions and token tier distributions are processed as discrete, consumable in-app purchases securely handled through Apple’s native In-App Purchase infrastructure.
  • No Refunds: Because all financial transactions are managed exclusively by Apple, all purchases are final. We cannot issue refunds, credits, or alternative currency exchanges for any tokens charged to your Apple ID. Any refund disputes must be initiated and processed directly through Apple's official customer support channels.
  • Failed Generations: If a generation fails due to an isolated technical error prior to asset delivery, our system will attempt to restore your credit token locally within the App. However, we are not liable for external third-party API service drops, Google Vertex AI outages, or cellular network failures beyond our control.

5. Ownership, AI Outputs, and Prohibited Conduct

Content Ownership & Image Warranties

We claim zero ownership rights over the inputs you provide or the videos and animated widgets generated by EvoWidget AI.

  • As Between You and Us: You retain full ownership over your inputs and outputs. You have the right to use, modify, share, and distribute your generated videos commercially or personally.
  • Your Image Warranties & Liability: By uploading images to the App, you explicitly warrant and guarantee that you own 100% of the legal rights to those images, or have obtained explicit, legally binding permission from the copyright owner to use them. You assume all legal and financial responsibility for the content you upload. You agree to defend, indemnify, and hold harmless Brian S Rosales and EvoWidget AI from any third-party claims, lawsuits, damages, or financial losses arising from your image uploads, including any copyright, trademark, or intellectual property violations.
  • Third-Party AI Terms: Generation is powered entirely by Google Vertex AI (Veo and Imagen 3). By uploading content, you acknowledge and agree to abide by Google’s Core Terms of Service, Google Cloud Terms of Service, and Generative AI Additional Terms of Service.
  • Copyright Limitations: You acknowledge that legal frameworks surrounding AI-generated art are evolving. We make no representations regarding whether your generated animations can be formally copyrighted under local intellectual property laws.

Prohibited Conduct

You agree not to manipulate or attempt to bypass the App interface or Google's safety parameters to generate content that is unlawful, threatening, abusive, defamatory, obscene, or infringing on third-party rights. You explicitly agree not to upload any images depicting explicit adult material, extreme violence, or non-consensual imagery. You further agree not to use the App, its generation outputs, or its technological behavior to train competitive machine learning models, reverse-engineer animation layouts, or develop a directly competing software application.

6. Proprietary Rights & Ownership of Technology

While you retain rights to your raw inputs and AI outputs, Brian S Rosales retains exclusive ownership over the EvoWidget AI application container, application source code, UI/UX layouts, asset pipelines, rendering logic, and the proprietary technology used to sequence, package, and compile the widget animations themselves.

You are strictly prohibited from decompiling, scraping, reverse-assembling, or copying our animation frameworks. Certain parts of our animation packaging system may utilize open-source code libraries or SDKs, which are used strictly in compliance with their respective open-source licenses (e.g., MIT, Apache 2.0) and are provided "as-is" without warranty.

7. Full Disclaimer of Warranties and Liability

THE APP AND ALL CONTENT GENERATED ARE PROVIDED “AS IS” AND WITHOUT WARRANTY.

Brian S Rosales disclaims all applicable warranties, implied or expressed. Because we operate strictly as an intermediary interface for Google Cloud Vertex AI, we make no warranty that the AI generation service will be uninterrupted, timely, secure, or error-free, or that the generated animations will match your expectations. We are explicitly not responsible or legally liable for Google's data processing, service availability, or the nature, safety, or legality of any outputs generated by their Veo or Imagen 3 models.

Operating System & iOS Specific Disclaimers

You acknowledge that all iOS widgets are ultimately updated, rendered, and controlled natively by Apple’s operating system framework. Consequently, we assume no liability for local device slowdowns, background battery consumption, widget freezing, or rendering bugs caused by system-level iOS updates, Apple OS restrictions, or background refresh limitations. Our technology is optimized as an engine, and while we do not expect excessive resource consumption, we cannot guarantee 100% runtime stability or prevent individual hardware variances from causing temporary operational strain.

Battery Consumption Disclaimer

While the App is designed to run efficiently, rendering digital assets, processing data pipelines, and displaying complex on-screen widgets may naturally consume device resources. You explicitly acknowledge and agree that We are not responsible or liable for any potential or actual battery draining, device overheating, or decreased battery health resulting from your use of the App or its widgets.

IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER—INCLUDING CONTENT/IMAGE FILE DELETION AFTER 48 HOURS, BACKGROUND SYSTEM OR BATTERY DRAIN, COPYRIGHT INFRINGEMENT SUITS RESULTING FROM USER UPLOADS, LOSS OF TOKENS, FINANCIAL LOSS, OR OPERATING SYSTEM FAILURE—ARISING OUT OF YOUR INTERACTIONS WITH THE APP OR THE THIRD-PARTY AI SERVICES.

8. Governing Law & Jurisdiction

This App is operated out of offices located within Texas, USA.

Any legal action, suit, or claim related to these Terms or the software shall be governed by the laws of the State of Texas, without regard to conflicts of law principles. You explicitly submit to the personal and exclusive jurisdiction of the state and federal courts located within Travis County, Texas for any legal proceedings, and agree that any claim must be brought within one (1) year from the incident date or be permanently barred.
